The Expedited Hearing Request Form is used for requesting an expedited hearing on a pending claim or application in accordance with Commission Rule 2.3. The form and instructions on how to file it are available on this page.

Commission Rule 2.3 provides that an employee may seek an expedited determination of any disputed claim arising after the initial compensability of the accident has been determined by the Commission. To qualify for an expedited hearing, the employee must demonstrate that the failure to grant an expedited hearing will result in severe economic hardship. If the dispute concerns medical treatment that has been denied, the employee must also demonstrate that the withholding of such treatment will threaten the employee’s life or result in immediate and severe deterioration of the employee’s physical or mental condition. Review the full text of Rule 2.3, 16VAC30-50-30. Expedited hearings will be conducted at VWC’s usual hearing sites.
